The U.S. Comptroller of the Currency issued a cease-and-desist order against Colleen Kimmel, former general counsel of Sterling Bancorp, even though it doesn’t allege she had any involvement in the $69 million fraud that threw the institution into chaos.

The defendant’s attorney, Randall Armentrout of Nyemaster Goode in Des Moines, told Law.com that the ruling was important, as previously there were no decisions interpreting Iowa’s Equal Pay Statute, which was passed in 2009.       

“These misrepresentations also ensured that Siemens was always on the ‘right side’ of its guarantees (falsely reflecting cost savings) to the HHC, which ensured that Siemens would not be held responsible for failing to deliver the energy savings that it promised when it sought HUD approval,” according to the plaintiffs’ complaint.
